Terms of the contest Roundabouts

The LEXUS Division of the company TOYOTA ESPAÑA S.L.U. (hereinafter referred to as LEXUS/the promoter/the organizing company), located at Avenida de Bruselas 22, 20108 Alcobendas (Madrid), will conduct and organize the promotion, the Rules of which are detailed below.

 

FIRST.- OBJECTIVE

The purpose of this promotion is to enhance the visibility of the LEXUS brand and bring the mentioned brand closer to users. Participants can consult the legal Rules on the page https://lexusroundabouts.es/en/terms-and-conditions/.

 

SECOND.- DURATION AND TERRITORIAL SCOPE

The promotion will run from January 14 to January 30, 2025, inclusive. The winners will be announced on January 31, 2025.

The Contest will have a national scope and can be redeemed within one year from the publication date of the winner.

 

THIRD.- PARTICIPATION, FREE ENTRY, AND ACCEPTANCE OF RULES

All individuals over 18 years old, who are legal residents in Spain and have a phone in Spain, may participate in the Contest, in accordance with the mechanism defined in Clause FIVE.

Under no circumstances may employees of LEXUS or third parties involved in the development of the promotion participate in this Contest. Violation of this rule will result in the loss of the awarded prize, in accordance with the provisions of Clause EIGHT.

Participants agree to make appropriate and lawful use of the website https://lexusroundabouts.es and all its content, in accordance with applicable legislation, these Rules, generally accepted morals and good practices, and public order. Users must refrain, among other actions, from:

  • Using the application or content in an unauthorized or fraudulent manner.
  • Modifying and/or attempting to modify the proposed promotional devices, particularly to alter results or any element determining the Contest’s outcome/winners.
  • Using the contents of the LEXUS page https://lexusroundabouts.es for illegal purposes or effects, contrary to the provisions of these General Conditions, good faith, or public order, damaging third-party rights and interests, or otherwise harming, disabling, or overloading the page or preventing normal use or enjoyment of https://lexusroundabouts.es.
  • Attempting to access, use, and/or manipulate the data of LEXUS, third-party providers, or other users.
  • Reproducing or copying, distributing, enabling public access through any public communication method, transforming, or modifying the content unless expressly and previously authorized by the rights holder or if legally permitted.
  • Modifying and/or attempting to modify the source code of any of the pages and/or promotions.

Participation in this action is free of charge.

LEXUS reserves the right to freely accept or reject the registration request of any participant in cases where there is reasonable suspicion that the user does not meet the required criteria.

LEXUS reserves the right to eliminate any participation deemed fraudulent or that violates any conditions detailed in these Rules.

LEXUS will not be responsible for damages caused by incorrect, inaccurate, or false information provided by the user during registration or afterward.

Participation in this Contest implies acceptance of all terms and conditions included in these legal Rules.

Exceptionally, and for duly justified reasons, LEXUS reserves the right to modify these Rules at any time, as well as any other general or particular conditions, usage regulations, instructions, or notices that apply. LEXUS also reserves the right to suspend, interrupt, or cease the operation of the website referenced above at any time.

In case of doubts or discrepancies in interpreting these Rules, LEXUS’s criteria shall prevail.

 

FOURTH.- PRIZE

The prize consists of:

  • One (1) night in a 5-star hotel for two (2) people + a dinner for two (2) people at the same hotel (maximum value: €500).
  • Use of one (1) LEXUS vehicle (the model will be chosen by the brand) for one (1) weekend. The vehicle will be picked up on Friday at the Lexus Madrid Norte dealership and returned on Sunday during business hours.

The prize is as described and does not include other concepts (e.g., transportation to the car pickup location or accommodations), except those provided for in these Rules.

Due to the prize’s value (€500), its delivery is subject to tax obligations as established in Clause SIX, requiring the winning participant to sign the corresponding prize acceptance document.

 

FIFTH.- MECHANISM, WINNER SELECTION, AND PRIZE DELIVERY

Mechanism

Users must access the website https://lexusroundabouts.es and correctly complete the registration form enabled for this purpose, accepting these legal Rules and the privacy policy.

Winner Selection

One (1) winner will be randomly selected from all participants.

If, for any reason, the winner cannot or does not wish to accept the prize, renounces it, or does not respond within 24 hours of being named, LEXUS will proceed to designate the next winner on the reserve list, up to a maximum of two (2) alternates. If the other reserve winners also refuse or renounce the prize, it will be declared void. LEXUS will manage the prize delivery after verifying the winner’s details, provided they meet the requirements in these Rules.

 

SIXTH.- PRIZE CONDITIONS

  • Providing truthful data at the time of registration is an essential condition for accessing the prize. Otherwise, all rights to the prize will be forfeited. Similarly, no winner who has used fraudulent means of participation will be accepted.
  • A winner with incomplete or untraceable data will not be considered.
  • The prize is personal and non-transferable; it cannot be assigned or transferred in any manner, nor exchanged for cash or other prizes.
  • The winner must prove their identity by presenting their ID card or other identity documents and comply with the conditions specified in these Rules, as well as ensure the accuracy of the data they provide.
  • LEXUS reserves the right to substitute the prize for another of equal or greater value, with the same or similar characteristics, if deemed necessary.
  • LEXUS will not cover any additional costs arising from the use of the prize.

Prize Taxation

Under the current tax legislation, participants are informed that prizes awarded for participating in games, contests, raffles, or random combinations linked to the sale or promotion of goods or services are subject to income tax withholding or payment on account if the prize value exceeds €300. Additionally, if the winner resides in a country other than Spain, the prize amount may be subject to payment on account of the Non-Resident Income Tax (IRNR).

In compliance with current tax regulations, LEXUS will apply the corresponding withholding or payment on account for the prize and issue the appropriate certification to facilitate the winner’s tax compliance. This includes incorporating the prize value into their income tax return along with other income received, with the possibility of deducting the withheld amount as indicated in the certification.

The winning participant must confirm their personal and contact details on the prize delivery day and present their ID or Residency Card. To facilitate the aforementioned withholdings, the winner must sign a receipt acknowledging the prize upon delivery. Failure to do so will result in losing the right to the prize without compensation.

The completion of personal and tax data necessary for prize delivery is mandatory. The absence of any such data will result in the loss of the awarded prize without compensation.

 

SEVENTH.- FRAUD

If LEXUS or any entity professionally associated with this promotion detects any anomaly or suspects that a participant is hindering its normal operation by unlawfully altering their registration and participation through technical or IT procedures, LEXUS may, unilaterally, disqualify the participant in question. It is important to note that LEXUS has implemented the necessary technological measures to detect any fraudulent, irregular, or malicious activity aimed at winning the prize illicitly. Therefore, LEXUS reserves the right to remove from registration any participant who evidences or is suspected of irregular conduct as described.

 

EIGHTH.- PARTICIPATION LIMITATIONS

The following are not eligible to participate in the Contest and therefore cannot win:

  1. Employees of LEXUS.
  2. Employees of companies, advertising agencies, or promotional agencies involved in creating and developing the Contest.
  3. Direct relatives (parents, siblings, or children) of individuals mentioned in points 1 and 2.
  4. Spouses of individuals mentioned in points 1, 2, and 3.
  5. Participants without a phone number registered in Spain.

LEXUS reserves the right to request reliable personal accreditation from participants.

 

NINTH.- IMAGE RIGHTS

The winner authorizes LEXUS to reproduce and use their name, surname, and other details, as well as their image, in any promotional activity related to the Contest, without such use entitling them to remuneration or any benefit other than the delivery of the awarded prize. The winner expressly authorizes LEXUS to publish their name, surname, and image on the LEXUS website and social networks.

 

TENTH.- CLAIMS

The claim period for this promotion ends 90 calendar days after the promotional period concludes.

 

ELEVENTH.- LIABILITY

LEXUS will not be responsible for errors or failures caused by factors beyond its control. LEXUS will also not be liable for force majeure (such as strikes, attacks, weather conditions, etc.), fortuitous events, or unforeseen circumstances that may prevent the winner from fully or partially enjoying their prize, and it shall be exempt from all liability if any of the aforementioned situations occur.

The descriptions herein are for informational purposes only and may be subject to future changes in compliance with these Rules and the evolution of https://lexusroundabouts.es. Therefore, the descriptions provided in the dedicated Contest or game spaces will always prevail.

LEXUS will not be responsible for the services provided by any other entity it collaborates with in providing services to the winners, resulting from the awarded prizes, or due to negligent behavior during their use.

LEXUS reserves the right to modify any provisions of these Rules at any time.

11.1. Exclusion of Guarantees and Liability for Website Operation

LEXUS does not guarantee the availability or continuous operation of the website https://lexusroundabouts.es.

Additionally, LEXUS will not be liable for any damages or losses that may result from:

  • Lack of availability or access to https://lexusroundabouts.es.
  • Interruption in the operation of the website https://lexusroundabouts.es, IT failures, phone malfunctions, disconnections, delays, or blockages caused by deficiencies or overloads in telephone lines, Internet systems, or other electronic systems during operation.
  • Other damages that may be caused by unauthorized third-party intrusions beyond LEXUS’s control or the presence of viruses or other elements that may alter users’ physical or logical systems, electronic documents, or files.

11.2. Exclusion of Guarantees and Liability for the Use of Facebook

LEXUS will not be responsible in any case for the use made by users and/or third parties of https://www.facebook.com/lexusspain or its contents or contests, nor for any damages or losses that may arise from it.

LEXUS is not responsible for potential losses, damages, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this promotion. LEXUS does not assume responsibility for any damage or harm of any kind that participants or third parties may suffer.

In no case will LEXUS be responsible for the services of any other entity with which it collaborates in providing services to the winners, resulting from the awarded prizes, or due to negligent behavior during their use.

 

TWELFTH.- PERSONAL DATA PROCESSING

The contact details you provide in this form are incorporated into the LEXUS Customer Database (managed by its Dealership, the Lexus Division of Toyota España S.L.U., Toyota Motor Europe S.L.U., and, if you are interested in their services, Toyota Kreditbank GMBH Spain Branch, Aioi Nissay Dowa Insurance Company of Europe Limited Spain Branch, and Toyota Insurance Management Ltd Spain Branch, all domiciled for this purpose at Avda. de Bruselas, 22, 28109, Alcobendas, Madrid). These details will be used to facilitate and manage the user’s request to participate in the contest, communicate the winner, and send the prize, conduct service satisfaction surveys, and perform statistics and studies necessary to improve their products and services. Processing your data is necessary to execute your request (legal basis: contract). The data will be kept for one year unless the interested party requests deletion. To send commercial communications related to LEXUS, we will request your consent; for this purpose, you will receive an email to confirm your desire to receive communications from the brand. No data will be transferred to third parties unless legally required or necessary to provide a service requested by the Customer. THIRTEENTH.- ACCEPTANCE OF RULES. APPLICABLE LAW AND JURISDICTION

Participation in the Contest implies full acceptance of these Rules and express submission to the interpretative decisions made by LEXUS.

LEXUS reserves the right to take any actions available under the law to enforce the responsibilities arising from the breach of any provisions of these Rules by a user.

In case of discrepancies regarding the Contest and the interpretation and/or application of these Rules, the Courts and Tribunals of Madrid, capital, will have jurisdiction, without prejudice to the jurisdiction that may correspond to consumers by law.

 

FOURTEENTH.- MODIFICATION OR SUSPENSION OF THE PROMOTION

LEXUS reserves the right to suspend, extend this promotion, or even its possible cancellation, provided there is justified cause, committing to communicating the new Rules, conditions, or, where appropriate, the definitive cancellation, in the same media and supports used for the dissemination of this promotion.

 

FIFTEENTH.- CONSULTATION OF RULES

The Rules will be available to anyone interested on the LEXUS page https://lexusroundabouts.es and at the LEXUS headquarters located at Avenida de Bruselas 22, 28108 Alcobendas (Madrid).
